The Onslow County District Attorney's Office confirmed the news to ABC7's sister station, WTVD-TV Wednesday afternoon.
An autopsy on Mariah's body was conducted and her remains were released to her family although the autopsy results are not yet public.
Those test results will be crucial in determining exactly what happened to the little girl and who, if anyone, should be charged with her death.
A body found in North Carolina has been positively identified as 3-year-old Mariah Woods, who was the subject of an Amber Alert that garnered national attention. Earl Kimrey, 32, the mother's live-in boyfriend, was arrested December 1 and charged with concealing of death; obstruction of justice, second-degree burglary, felony larceny, and possession of stolen property.
Additional charges against Kimrey could be pending as the investigation continues.
